These Terms & Conditions ("Terms") govern your access to and use of the Moment Shopping website (momentshopping.com), our mobile application, and related services (together, the "Platform"). The Platform is owned and operated by Moment Enterprise, a proprietorship having its registered office at Shivmandir, Panchayat Road, Siliguri, West Bengal – 734011, India ("Moment Enterprise", "we", "us", "our").
By accessing, browsing, registering on, or purchasing through the Platform, you ("you", "user", "customer") agree to be bound by these Terms, our Privacy Policy and our Returns & Refunds Policy, which together form a legally binding agreement between you and Moment Enterprise. If you do not agree, please do not use the Platform.

2. Eligibility
You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872 to make a purchase. If you are under 18, you may use the Platform only under the supervision of a parent or legal guardian. By transacting, you confirm that the information you provide is true, accurate, and complete.
3. Account & Registration
Registration uses your mobile number and a One-Time Password (OTP). You are responsible for maintaining the confidentiality of your account and for all activity under it. You agree to provide accurate details and to keep them updated. We may suspend or terminate accounts that contain false information or are used for fraudulent, abusive, or unlawful activity.
4. Products, Descriptions & Availability
We make every reasonable effort to display products, specifications, images, and colours as accurately as possible. However, actual products may vary slightly, and we do not warrant that descriptions or other content are error-free. All products are subject to availability, and we may limit quantities, discontinue any product, or refuse or cancel any order at our discretion. Where required, the country of origin of a product is disclosed on its product page.
5. Pricing, Taxes & Payment
All prices are listed in Indian Rupees (₹) and are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise. The total payable amount, including any delivery or handling charges, is displayed to you at checkout before you confirm the order.
When you place an order, it is first recorded as "Pending Payment". Your order is confirmed only upon successful receipt of payment, or upon your selection of Cash on Delivery where available. We accept UPI, debit and credit cards, net banking, and EMI through our authorised payment partners. We are not responsible for any charges, declines, or issues arising from your bank or payment provider.
In the event of an obvious pricing error, we reserve the right to cancel the affected order and refund any amount already paid, even after order confirmation.
6. EMI & No-Cost EMI
EMI facilities are provided by third-party financing partners and banks, subject to their eligibility criteria and terms. No-Cost EMI offers may be an exclusive in-store experience and may not be available for every product or online. Approval of any EMI or finance application is at the sole discretion of the financing partner.
7. Delivery
We deliver across India through third-party logistics partners. Estimated delivery timelines shown at checkout are indicative and not guaranteed. Risk in the goods passes to you upon delivery to the address you provide. You are responsible for providing an accurate delivery address and for being available to receive the order.
8. Cancellation, Returns & Refunds
Order cancellation, returns, and refunds are governed by our
Returns & Refunds Policy, which forms part of these Terms. In summary: orders may be cancelled before dispatch; online orders may be returned within 7 days of delivery subject to conditions; and purchases made at our physical stores cannot be returned through the app.
9. Moment Coins & Privilege Club
Moment Coins are loyalty rewards offered at our discretion, where 1 Coin equals ₹1, and may be used to pay for up to 50% of a cart's value. Coins have no independent cash value, cannot be transferred or encashed, and may be adjusted, reversed, or forfeited in cases of order cancellation, return, fraud, or misuse, or on closure of your account. We may modify or discontinue the programme with reasonable notice.
10. User Conduct
You agree not to misuse the Platform, including by posting false or misleading reviews, impersonating others, attempting to gain unauthorised access, transmitting malware, scraping data, or using the Platform for any unlawful purpose. We may remove content and suspend access for any breach.
11. Intellectual Property
All content on the Platform — including the Moment Shopping name, logo, text, graphics, images, and software — is the property of Moment Enterprise or its licensors and is protected under applicable intellectual property laws. You may not copy, reproduce, or exploit any content without our prior written permission. Brand names and trademarks of products (such as Apple, Samsung, and others) belong to their respective owners.
12. Third-Party Links & Services
The Platform may contain links to or integrations with third-party services (such as payment gateways, logistics, and messaging providers). We are not responsible for the content, policies, or practices of any third party, and your use of those services is subject to their own terms.
13. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis. Product warranties, where applicable, are provided by the respective manufacturers and are subject to their terms. To the extent permitted by law, we disclaim all implied warranties relating to the Platform itself.
14. Limitation of Liability
To the maximum extent permitted by applicable law, Moment Enterprise shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform. Our total liability for any claim relating to a purchase shall not exceed the amount paid by you for that purchase. Nothing in these Terms limits your statutory rights as a consumer under the Consumer Protection Act, 2019.
15. Indemnity
You agree to indemnify and hold harmless Moment Enterprise and its officers and employees from any claim or demand arising out of your breach of these Terms or your violation of any law or the rights of a third party.

17. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to applicable consumer protection laws, the courts at Siliguri, West Bengal shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Platform.
18. Changes to These Terms
We may revise these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date, and your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
